03 / CONTINUITY OF GOVERNMENT
Presidential succession 18 successor offices The Vice President comes first, followed by the congressional officers and department heads in the order below. The President is not a successor position. The Constitution governs vice-presidential succession; 3 U.S.C. §19 provides the order after the Vice President.
Eligibility not assessed These are office positions, not a determination that each named person may assume the presidency. Constitutional eligibility, Senate appointment requirements and other legal conditions apply. An acting department head is not automatically a qualified successor.
Read the legal conditions The Speaker and president pro tempore must resign their congressional offices and seats to act as President under §19. For department officers, §19(e) requires appointment with the Senate’s advice and consent before the statutory triggering event and excludes those under House impeachment at devolution. The statute also governs inability, duration of service and prior entitlement. No individual’s constitutional eligibility is calculated here.
